Another one bites the dust
Another file-sharing software maker has been found guilty of causing copyright infringement. A US judge has said the Morpheus software produced by StreamCast breaks the law.
The ruling is another victory for the entertainment industry, which has had a string of recent victories and concessions. Just weeks ago Kazaa settled with the music industry for $100m.
MetaMachine was ordered to pay $30m to settle a copyright suit earlier this month over its eDonkey and Overnet file sharing software. Napster shut down and only the brand survived, now fronting an authorised download site and Grokster has been shut down by courts.
In 2003 Judge Stephen Wilson ruled that StreamCast could not be held responsible for the actions of its software’s users, a decision that was backed by the appeals courts. Last year, though, the Supreme Court in the US ruled that file sharing software companies were liable for the software’s use because they encouraged or induced users to commit copyright theft.

Media player will have same price and capacity as Apple’s updated iPods
Microsoft has confirmed the launch date and retail price for its Zune portable media player.
The device will be launched on 14 November and will be priced at $249.99 for the 30GB version.
The price tag puts the Microsoft player in direct competition with Apple’s newly-updated 30GB iPod which retails for the same price.
Like SanDisk’s Sansa e200 series, the Zune will come pre-loaded with music and video content.

Autumn is apple-picking season, so somehow it seems appropriate that Apple would do some picking of its own. Only in this case, it picked some bugs.
The company released a batch of 15 fixes to security holes and vulnerabilities across the operating system and applications.
The update brings the Macintosh OS to revision 10.4.8. The last update came in June. Some of the new fixes are for some pretty interesting bugs. In one case, a corrupted JPEG2000 image could be created to cause a buffer overflow error and arbitrary code execution.
A similar fix was issued for corrupt PICT images, where code could be embedded in the image and cause a buffer overflow and code execution. Apple also issued a pair of Kerberos security-related fixes, a patch to its Safari browser and one for Adobe’s Flash multimedia player.
In more positive news, Microsoft released Messenger for Mac 6.0. The new version, available for both PowerPC and Intel-based Macs, lets users tell people what you are listening to on iTunes. Another new features is communication with Yahoo Messenger.

Microsoft is predicting that Windows Vista will be adopted by companies at twice the speed as its predecessor, Windows XP.
Twelve months after the release of Vista, Microsoft expects that usage share of the oft-delayed operating system in businesses will be double that of XP a year after it shipped, said Brad Goldberg, general manager for Windows product management at the software maker.
“Vista is built for businesses,” Goldberg said. “We’re giving businesses the tools they need to get out of the gate faster with Vista…Our goal is to have twice as fast deployment of Vista than for any other operating system.”
Microsoft declined to give its own figures on Windows XP’s usage percentages, and instead referred to research by IDC. According to the analyst company, XP was installed on about 10 percent of enterprise PCs after a year. That would put the goal for Vista at 20 percent.
“For them to do 20 percent in the first 12 months of availability is almost impossible,” said Al Gillen, an analyst at IDC. “They have done all the right things, but adoption is going to be driven by corporate adoption and deployment cycles, more so than by whether Microsoft has greased the skids to make the product glide in faster.”

Move mirrors Dell’s Alienware purchase
HP has agreed to acquire Voodoo, a maker of high-end gaming PCs, for an undisclosed sum.
The acquisition comes several months after Dell purchased Alienware, another high-end PC manufacturer. Alienware is considered the largest gaming PC manufacturer, followed by Voodoo in second position.
Voodoo PCs can cost thousands of dollars and feature the latest and fastest microprocessors and graphics cards, and advanced cooling systems.
In the world of competitive gaming, having the fastest hardware can offer players a significant edge over their opponents.
These high-end PCs stand out by their case designs which typically sport bright colours and Plexiglas windows to show of the system’s hardware and features such as fluorescent water cooling systems.
The expensive systems offer higher profit margins than regular consumer and enterprise PCs.

Search rivalry with Google heats up…
Yahoo! has announced a deal with HP whereby the company’s search engine and other services will appear on all HP consumer systems sold in Europe and the US.
Although the deal focuses on consumers, a spokesman for Yahoo! confirmed it has its eyes on business too. He said: “There are no specific plans to go to business as yet but it’s something we’re looking into.”
As of today, all new HP desktops and laptops will have Yahoo! as the default search service in Microsoft’s Internet Explorer web browser, which is pre-installed on the machines. HP users will also have instant access to Yahoo! search, email, news and finance services.
Earlier this month Yahoo! signed a similar partnership with PC maker Acer.

Microsoft’s 30GB Zune digital-media player will sell for $249 when it hits store shelves on Nov. 14, the company said Thursday as it released more details on the device.
The Zune’s price will put it in direct competition with Apple Computer’s latest 30GB iPod, which also costs $249.
To introduce the companion Zune Pass music service, the device will come preloaded with songs, music videos and film shorts from the store. A Zune Pass will cost $14.99 a month, or $44.97 for three months.
“It’s clear that we are not going to see a pricing war at this predictable moment. They are not going to undercut Apple’s prices. But given the lack of volume discount and the screen size and the Wi-Fi capability included on it, $249 is still an aggressive price point,” said Michael Gartenberg, research director at JupiterResearch.
There will also be the option of purchasing individual songs through a system called Microsoft Points. The new Microsoft cash system will work by adding money to an account, as with a prepaid phone card. Points will then be deducted from the account with each purchase. A single song will cost 79 points, “the equivalent of 99 cents,” according to Microsoft spokeswoman Kyrsa Dixon.
The point system is already used in the Xbox Live Marketplace, and Microsoft plans to host other online stores where Microsoft points can be redeemed, according to Katy Gentes, product marketing manager for Zune. In the United States, points are available in denominations of $5 for 400 points, $15 for 1,200, $25 for 2,000 and $50 for 4,000. That makes $1 worth about 80 points.
Gentes said this system will enable Microsoft to sell retail gift cards of Microsoft points that could then be split over different Microsoft online stores. It will also act as a common global currency for Microsoft products, according to Gentes.
Microsoft said Zune software will play files in several popular formats, including the AAC format used by Apple’s iTunes software.

Second major Microsoft vulnerability in two weeks
Microsoft has been hit by another major security problem following the discovery of a vulnerability in its PowerPoint software.
The unpatched PowerPoint flaw is believed to allow hackers to run malicious code, such as a worm, on both Windows and Apple Mac computers.
This fresh issue comes just two weeks after a major problem with the Vector Markup Language (VML) in Internet Explorer, which forced Microsoft to issue an early patch.
“It has been a bad few weeks for Microsoft on the security front,” said Graham Cluley, senior technology consultant at Sophos.

Yahoo Messenger and Windows Live Messenger today announced that they have connected their Instant Messaging (IM) communities.
The move forms the world’s largest IM network, with around 350 million user accounts and means people using Yahoo’s Messenger and Windows Live Messenger will be able to exchange instant messages across the free services, see their friends’ online presence, share a selection of emoticons and add new contacts from either service.
Yahoo said its research shows that almost a third of IM users were keen to communicate with friends and family on other IM networks, and if they could they would get in touch more frequently.

Microsoft issued a rare, out-of-cycle Windows patch on Tuesday that fixed one flaw, but attacks through other known, yet-to-be-plugged holes continue.
Microsoft on Wednesday warned of “limited zero-day attacks” that exploit a new flaw in PowerPoint, Microsoft’s widely used presentation tool. For the attack to be carried out, a user must first open a malicious PowerPoint file attached to an e-mail or otherwise provided to them by an attacker, Microsoft said in a security advisory.
“This issue can allow remote attackers to execute arbitrary code on a vulnerable computer,” Symantec said in an alert sent to customers. The flaw affects PowerPoint in Office 2000, Office XP and Office 2003 on Windows and Apple Computer’s Mac OS X, it said. Attacks appear to be aimed at specific targets, Symantec said.
For temporary protection against PowerPoint attacks, Microsoft suggests keeping security software up-to-date and not opening presentations files from untrusted sources. Also, PowerPoint Viewer 2003 is not vulnerable, the company said.
